Most EULAs aren't enforceable, here in the EU, because you can't sign away your rights. I could get you to sign away your first born, but when the time comes and I knock on your door, I wouldn't legally have a leg to stand on. So the question is: is jail breaking your phone a criminal offense? IANAL but I don't think it is.

Apple could sue you for damages, of course, but they would have a hard case arguing how this lost them money.
