the possession part maybe. but there is the bigger picture - she's posting them on the net, so it doesn't matter if she's willing or not or if she took them or not, she is posting pics of child porn on the net. I don't know that she should be arrested though - they should use the pics to go after the pedo's that were downloading them knowing she was under age.

might also be other under-age peeps in some of the pics.

It IS worth getting the authorities involved imo, but those charges are ridiculous.

She has been charged with sexual abuse of children, possession of child pornography and dissemination of child pornography.

The last one could stick, the rest are nonsense. The law as it's written clearly doesn't accomodate for this kind of underage self-exposure, perhaps it should, so that these children can be dealt with appropriately rather than with excessive harshness as one would expect from the scape-goating pedophile trip the US seems to be on as of late.

In her case, perhaps a good talking to and compulsory counselling to hash out some issues would do.

Extreme aggresiveness in it's own right needs to be judged against consequences (weighing discernable good and bad outcomes), with decisions made accordingly. I don't see that happening in the US atm.

That much I have to agree with, shit like this has been overreacted toward for quite some time. There was the story of the kid recently who got charged because spyware left his computer open to being hijacked and the hijacking was done by child pornographers - the kid ended up getting charged with 9 counts of child porn, and if he hadn't been saved by 20/20 raising a fuss he could likely have gone to jail for 10 years per infraction.

Each infraction, btw, was a fucking single jpg.

I haven't followed the prosecutorial and law enforcement trends closely enough to know if they are weighing discernable good and bad outcomes in most cases. What exactly do you mean by a bad outcome in this context?

Take one approach, not seriously suggested, but for the sake of argument. Let's say we choose to execute repeat or serious first-time sexual offenders, one would assume this would lead to fewer sexual offenders/predators and fewer sexual offenses. The downside would be that those sexual offenses that take place would more likely lead to the murder of the victim following that offense. There are a host of other potential side effects and unreflected upon consequences, but there appears to be hardly any reflection when these laws are written and passed.

Does this scenario happen?

Teens make some sex vid and post it on a video sharing site. Some business man family guy is searching for regular porn on said site and comes across (pun inteded) that teeny video without ever knowing it is child porn by definition. Authorities become aware of vid, determine who viewed and or downloaded, and prosecute. So guy gets charged for not realizing he was seeing a 16 year old instead of an 18 year old.

I really want to see a judge try her as an adult. LOL.
