English Legal Sysytem...

I left my job nye of 2007, and so took my final pay packet on the 7th January 2008.... or so it should have been, I've just logged into to my online banking to see another month's wage deposited in there in the early hours of this morning. If I had any respect, or even liked my previous employers I'm a good enough guy to tell them of the mistake and hand the money back, however, they're cunts and I hate them. Plus, I've just moved city and I'm now one skint motherfucker. Does anyone know where I stand legally? presumably they can't just take the money out of my account, they have to ask for it back right? and if I say no... is there anything they can do?? Can I claim ignorance? "I'm sorry I don't check my account, I just spend what's there, so its gone, sorry!!"

Obviously I wanna keep it, but I don't want to find myself in court in the next few months having bought a holiday and loads of night's out getting wasted on the company's budget.

It's a simple case of you undervaluing your worth/severance.
Why do you feel you have to accept what they decide.
Look at it this way...they underpaid you every month you were there and this is the way life evens things out.

Make them fight for it back if they care to try.

i would also tell them, and it is prob vacation pay or somshit..

i've had a simular situation happen to me, called em up and it was all good.. no mistakes..

Sometimes when you leave, they have to give you 2 weeks severance pay. But that's usually when you get fired.

haha. so this one guy that worked at friday's for like...7 years (it was a temporary job you know)...they pissed him off so he was gonna use up his 2 weeks of vacation and quit...u know...show them so he took his 2 weeks of vacation. and then he showed up and worked

i think it's important that you ask other people what you should do since what should be done is not remotely obvious from your description of the scenario

basically, you want a bunch of compete strangers on the internet to help you to feel ok about keeping the money, maybe hoping someone here is a lawyer who knows about the 'paid too much you keep it' loophole in the law

This happened to a friend of mine a few weeks back. From what I found out they can take you to court to get the money back so you may as well just give in. With my friend they asked him to give them a cheque to pay the money back, so what I'd do is tell them you're taking off say £100 for the inconvenience. :up:

Say nothing, let them figure it out - and don't spend it all yet in case they discover their error. If it is an error in the first place, it sounds very much like vacation / severance pay.

I might be a slight fool, but I'm not retarded, I'm familiar with holiday pay, but I don't think the 3 days I had left unused warrants a full month's pay, plus any unused holiday comes in your last paypacket, not a month later. And to those taking the piss cos I say "I'm a good person but I want to keep it", you find a wallet full of money in the street, do you take it into the police station without taking the money first? do you bollocks. we're all greedy at the end of the day, whether you like to admit it or not. fuck it, I'm keeping it and keeping quiet. it's their mistake, I'll wait for them to figure it out.

they could have fucked you for it anyway, if they overpay you, and it is reasonable that you would realise that it was an error, unless you query it and get told its not an error, they can demand it back.

on a similar note, TSB tried to anally rape me, 100 quid got put in by my Mum, when I checked my statement, there were two payments, same day for 100 quid.
I went in and asked the bank why, they said it was not an error, I asked if I spent it and it turned out to be an error, would I have to pay it back, then told me again that it wasnt an error, and that I wouldnt have to pay it back.
I spent it, it was an error, they asked for it back, phoned up my company to bitch about it and were totally gay. I didnt pay it back, and had to open an account with another bank.fucking cocksuckers
