Both coming out in about a month...I'm thinking the max...screen is slightly bigger and the form factor is just pretty...no?...

I love my s3 it just does what i want when i want no bs, i saw a note (not sure what one a 2 maybe?) for 200$ at costco today and i said to myself, that is a great thing just as a wifi , very powerful and useful!

Samsung is significantly better than HTC when it comes to timely software updates, which is definitely something to consider.

htc all the way. samsung is a cheap plastic POS in comparison to the craftsmanship that goes into HTC's

I'd go for HTC. I've had an HTC for two years, dropped it probably 100 times and it still works like a champ. My friends have all gone through 3-4 Samsungs in the same amount of time.
That said, the HTC (at least the one I have) seems to be relatively tricky to root, if you're into that sort of game. *shrug*

I like Samsung devices because you can easily swap out the battery and can put in an SD card. I'm guessing the same will be true with the Note 3. How about HTC one max?

My provider kept pestering me about updating, so I'm on jellybean now.
Maybe some things are optimized behind the screens, but I can't really tell the difference with 2.3 except some cosmetic stuff.

it's true... my LG is locked in tight.. you can open it, but it is a fucking nightmare. But it was the lesser of two evils since the only other option with my carrier at the time was a gaylaxy S3

Not really. I've heard people complain about Samsung being slow with updates and my personal experience with the JB update for my Galaxy Note 10.1" is that it was delayed time and time again. But do consider that usually it's not the manufacturers that are the bottleneck, but the providers. Aside from ASUS, Samsung are regarded as one of the best at updating their phones. Most of their flagships get at least two major updates compared to other OEMs. S2 went from GB to ICS to JB. Note 2 is jumping straight from 4.1.2 to 4.3. The S3 went from ICS to 4.1.2 to 4.2 and might be getting 4.3 as well. Contrastingly, HTC tends to average closer to one major update, even for their flagships. Plus they have disasters like the Thunderbolt.
Go Nexus or go home. The Google Play Edition phones will be interesting to watch. 4.3 was released on Nexus devices exactly a week ago, so let's see how long it takes them to update.
